Prominent lawyer Miguna Miguna has publicly expressed his support for impeached former Deputy President Rigathi Gachagua, a move that has surprised many.
On November 1, 2024, Miguna took to his X account to encourage Gachagua to pursue his legal battle all the way to Kenya’s Supreme Court.
“To Rigathi Gachagua: Fight all the way to the Supreme Court.
It doesn’t matter if they rule against you.
Do it for the record,” Miguna urged, emphasizing that such a fight would also highlight the weaknesses of the charges against Gachagua.
Miguna, known for his past conflicts with the government, suggested that taking the case to the highest court would expose the judiciary and the validity of the allegations being made.
“You must expose them in open court from the compromised three-judge bench to the colonized Supreme Court,” he stated.
Despite having previously clashed with Gachagua over his support for former President Daniel Moi during the 1980s, Miguna now sees Gachagua as a victim of a political witch hunt.
“For some of us, it doesn’t matter that we have disagreed with you since 1987 when we fought against Moi’s tyranny. You are now facing repression yourself,” he added.
Miguna cautioned Gachagua against succumbing to government pressure, warning that doing so would end his political career.
“If you surrender, Ruto will bury you without clothes. Never, ever, kneel down before anyone,” he asserted.
This endorsement followed Gachagua’s announcement on social media that he had returned to his home in Mathira to spend time with his family,
Updating his profiles to reflect a more personal identity as “Husband, Father, Kenyan,” rather than as Deputy President.
Gachagua’s official tenure as Deputy President concluded on October 31, 2024, when the High Court lifted conservatory orders that had previously blocked the swearing-in of nominated Deputy President Kithure Kindiki.
A three-judge bench ruled that the orders were hindering government operations, noting that a vacant Deputy President position was contrary to public interest and constitutional mandates.
Miguna reiterated his dedication to upholding the Kenyan Constitution, advocating for genuine democracy, constitutionalism, and the rule of law, including the right to a fair trial and respect for human rights.
“We are committed to zero tolerance for impunity,” he concluded.
