The Director of Public Prosecutions (DPP) has directed the Directorate of Criminal Investigations (DCI) to conduct thorough investigations into the collapse of a multi-storey building in Eastleigh, Nairobi, following reports of injuries, property damage and missing persons.
In a press statement, the Office of the Director of Public Prosecutions (ODPP) said the investigations would establish the circumstances that led to the incident and determine whether any individuals or institutions could bear criminal responsibility.
The DPP clarified that the Nairobi City County Government had not forwarded any inquiry file concerning possible wrongdoing by the developer, construction professionals or county officials for review and directions before the incident.
“The DPP has, pursuant to Article 157(4) of the Constitution of Kenya, directed the Director of Criminal Investigations (DCI) to conduct thorough investigations into the matter,” the statement read.
The investigations will examine whether any acts or omissions by Nairobi City County officials, the private developer, contractors or other professionals involved in the planning, approval, supervision and construction of the building contributed to its collapse.
The ODPP said the inquiry would establish whether building regulations, safety requirements and statutory approval procedures were followed during the construction process.
Upon completion of the investigations, the DCI is expected to forward the inquiry file to the ODPP for an independent review and further directions in accordance with the Constitution and the law.
The prosecution agency warned that anyone found culpable could face criminal charges, regardless of their position or status.
“Where sufficient evidence establishes criminal culpability, the ODPP shall take the necessary prosecutorial action against any persons found responsible, irrespective of their position or status,” the statement said.
The DPP also expressed sympathy for those injured in the collapse and individuals who suffered property losses, while cautioning developers, contractors, construction professionals and public officials against disregarding building regulations and safety standards.
The office stressed that any conduct amounting to a criminal offence would be dealt with in accordance with the law.
The Eastleigh building collapse has raised concerns over construction safety, regulatory oversight and compliance with building approval requirements in Nairobi.
The ODPP reaffirmed its commitment to accountability and the rule of law, stating that it would continue working with investigative agencies to ensure that cases warranting prosecution are handled in accordance with the law.
