High Court Suspends Arrest And Prosecution Of Kiambu Governor Kimani Wamatangi


The High Court has issued a conservatory order preventing the arrest and prosecution of Kiambu Governor Kimani Wamatangi amid ongoing investigations.

Justice Chacha Mwita ruled that the Office of the Director of Public Prosecutions (ODPP) and the Ethics and Anti-Corruption Commission (EACC) are barred from arresting or charging the governor until September 18, 2025.

“A conservatory order is hereby issued by refraining respondents from arresting and charging the petitioners based on the investigations undertaken in this matter until September 18, 2025,” the judge stated.

This decision allows Governor Wamatangi to continue his official duties uninterrupted while the court considers the allegations of corruption within his administration.

The final court ruling on whether the prosecution can proceed is expected on September 18.

The judge noted that the ODPP has yet to make a formal decision on whether to prosecute the governor.

The legal proceedings follow an April 15 raid by the anti-graft agency at Governor Wamatangi’s home and county offices, which also saw the arrest of nine senior county officials.

The investigations focus on suspected embezzlement of public funds and conflicts of interest.

Officials under investigation have dismissed the allegations as politically motivated, aimed at undermining the governor’s administration.

Governor Wamatangi has echoed these sentiments, describing the raid as political intimidation and reaffirming his commitment to delivering county projects without distraction.

The court’s ruling offers temporary relief to the governor as the legal process unfolds, ensuring stability in county leadership during this period.
