Court hands life sentences to three men in violent robbery cases


A court sitting in Ngong and presided over by Senior Resident Magistrate Hon. Hellen Mosomi has sentenced three men to life imprisonment after finding them guilty of robbery with violence, a capital offence under Kenyan law.

The convicts Brian Kutitila Wanyama, Japhnae Wanyonyi Mukalama, and Thomas Wakoli Malava were convicted after the Prosecution presented compelling evidence that left no room for doubt regarding their involvement in a violent robbery incident.

The court heard that on December 18, 2021, in Kibiku, Kajiado West, the trio violently robbed Andrew Muthure Wairia of a Huawei Y9 mobile phone worth Sh24,990, a memory card valued at Sh3,995, and a pair of Reebok shoes worth Sh4,000.

Further investigations revealed that the accused later transferred Sh3,970 from the victim’s account to a mobile number registered under Wanyama’s name.

Before fleeing the scene, the attackers physically assaulted the victim, leaving him injured.

In delivering the judgment, Hon. Mosomi ruled that the Prosecution had proved all the elements of robbery with violence beyond reasonable doubt, sentencing each of the three men to life imprisonment.

In addition to the life sentence, Brian Kutitila Wanyama was convicted on a separate charge of willfully resisting arrest during his apprehension on December 29, 2021, in Bulbul, Kajiado North.

For this offence, he received an additional two-year jail term.

Moreover, the court also convicted Thomas Wakoli Malava in a separate robbery case, where the Prosecution demonstrated that on September 5, 2021, in Oloolua, Kajiado North, Malava, alongside accomplices, violently robbed Patrick Nyaga Kariuki.

Stolen items in this second incident included a smart TV worth Sh95,000, a Honda concrete vibrator valued at Sh36,000, mobile phones worth Sh44,000, and cash amounting to Sh50,000 bringing the total value of stolen property to Sh227,000.

The victim was also subjected to physical violence.

For this second conviction, Malava received another life sentence, reflecting the gravity of his repeated criminal conduct.

Both cases were successfully prosecuted by Prosecutor Filah Martins.
