The Office of the Director of Public Prosecutions (ODPP) directed that a prosecutor based at the Makadara Law Courts be charged with bribery following investigations by the Ethics and Anti-Corruption Commission (EACC).
In a statement, the Director of Public Prosecutions confirmed that an inquiry file forwarded by the EACC concerning Samuel Mugo Kiarie had been independently reviewed, and sufficient evidence established to sustain criminal charges against him.
The DPP consequently approved three counts of receiving a bribe contrary to Section 6(1) as read together with Section 18 of the Bribery Act.
Kiarie, who is stationed at the Makadara Law Courts in Nairobi, has been directed to be arraigned before a court of competent jurisdiction to answer to the charges.
The ODPP reiterated that no individual, regardless of office, rank or position, is above the law, emphasizing that the prosecution office will not hesitate to take decisive action against any officer who undermines the integrity of the criminal justice system.
“The ODPP remains committed to executing its constitutional mandate in accordance with the rule of law, public interest and the administration of justice,” the statement said.
The case underscores continued efforts by anti-graft agencies to strengthen accountability within the justice system and uphold ethical standards among public officers.
