Man jailed for 15 years for murder of his wife in Nyamira

The prosecution secured a 15-year prison sentence for Lawrence Gesore Sagero, who was convicted of murdering his wife, Nancy Mongina, in Nyamira County.

Nyamira High Court Judge Lady Justice Thripsisa Wanjiku Cherere found Sagero guilty of murder contrary to Section 203 as read with Section 204 of the Penal Code and convicted him under Section 322(1) of the Criminal Procedure Code.

The court heard that Sagero murdered Mongina on April 18, 2024, at approximately 9am in Borioba Village, Borangi Location, Nyamira North Sub-County.

During the trial, Sagero denied the charge, prompting the prosecution, led by Deputy Director of Public Prosecutions Joel Kibet Chirchir, to present evidence establishing the elements of murder beyond reasonable doubt.

The prosecution called six witnesses, whose testimony linked the accused to the killing.

A doctor who conducted the post-mortem examination testified that Mongina died from severe head injuries caused by blunt force trauma, resulting in cardiovascular arrest.

Medical evidence established that the deceased sustained repeated blows to the head, fracturing her skull and causing extensive bleeding in the brain.

The court found that the nature and severity of the injuries demonstrated malice aforethought, establishing that the prosecution had proved its case beyond reasonable doubt.

In determining the sentence, Justice Cherere considered the gravity of the offence alongside the mitigating circumstances presented before the court.

“Having balanced the gravity of the offending conduct against the mitigating circumstances, the Court considers that a substantial custodial sentence is warranted, but that the mitigation justifies a sentence below the maximum prescribed by law,” the judge ruled.

She consequently sentenced Sagero to 15 years’ imprisonment for murder.

The convict has 14 days within which to appeal the sentence.
