The Ethics and Anti-Corruption Commission (EACC) has recommended that Kitutu Chache North MP Japheth Nyakundi be charged over an alleged Sh57 million procurement fraud at the Rift Valley Institute of Science and Technology (RVIST).
He is also the UDA treasurer.
The commission said its investigations established that RVIST irregularly awarded a Sh57 million tender to Afripath Care Kenya Limited during the 2024/2025 financial year despite the company allegedly submitting fraudulent documents in support of its bid.
According to the EACC, the investigation found that members of the tender evaluation committee falsified due diligence records even though Afripath was non-responsive.
Members of the Inspection and Acceptance Committee were also accused of issuing an inspection and acceptance report despite medical equipment supplied by the company allegedly failing to meet the technical specifications contained in the tender documents.
The commission said the two committees consequently failed to perform their duties in accordance with the Public Procurement and Asset Disposal Act, 2015.
EACC further established that Afripath is owned by three directors, one of whom is the sole signatory to the company’s bank account and is a brother-in-law of MP Nyakundi.
The commission said the full Sh57 million tender amount was paid into Afripath’s bank account, after which Sh39.988 million was transferred to the MP.
The investigations further established that Nyakundi used Sh10 million of the money to purchase a parcel of land in Karen where he is currently building a house.
EACC said it compiled its investigation report and forwarded it to the Director of Public Prosecutions (DPP) on June 17, 2026, recommending charges against the MP, senior RVIST officials, the company and its directors.
The recommended charges include conspiracy to commit an offence of corruption, abuse of office, wilful failure to comply with procurement laws and procedures, making a false document, uttering a false document and fraudulent practice in procurement.
The suspects could also face charges of unlawful acquisition of public property, acquisition of proceeds of crime, money laundering and use of proceeds of crime.
The commission said its recommendations arose from a complaint concerning several tenders awarded by RVIST to Afripath, which resulted in cumulative payments of Sh39.988 million to the Kitutu Chache North MP during the 2025/2026 financial year.
EACC said it is awaiting the DPP’s response on the recommendations.
The DPP said the file is being reviewed for action.
