Court Issues Arrest Warrant for Habanos Lounge Director Over Noise Pollution Contempt


The Environment and Land Court has issued an arrest warrant for Maurice Asira, director of Habanos Lounge, after finding him in contempt of court for violating noise pollution orders.

In a ruling delivered virtually on August 28, 2025, Justice Charles Mbogo ordered that Asira appear before the court on October 22, 2025, to explain why he should not face imprisonment or a fine for disobeying judicial directives.

The case was brought forward by area residents, led by Mary Ann Wariithi, chairperson of the petitioner group, who accused the lounge formally operating as Taks & M Habanos Chill & Grill Limited of continuing to play loud music in violation of a court order issued on October 17, 2024.

Evidence presented to the court included expert noise level reports and sworn affidavits, confirming that the establishment had consistently exceeded the legal nighttime noise limit of 35 decibels.

Residents claimed the lounge operated with impunity, defying both county enforcement and the authority of the judiciary.

Justice Mbogo emphasized the seriousness of the violation:

“The first respondent is in total disobedience of this court’s orders and undermines the authority of the court. Such conduct will be dealt with firmly to prevent future defiance,” he ruled.

While the judge did not impose penalties immediately, he directed that Asira be apprehended and brought before the court, where he may face contempt charges that could result in a fine or jail sentence.

The case underscores growing frustration among residents over noise pollution and the apparent disregard of legal frameworks by some entertainment venues.
