Matatu driver flees traffic police on Valley Road, cites sudden diarrhoea in court

A matatu driver who was filmed fleeing from a traffic police officer along Valley Road has told a Nairobi court that he sped off due to a sudden bout of acute diarrhoea.

Donald Owuor Ndeda, driver of a Ganya Sacco Isuzu minibus, appeared before Milimani Magistrates Court to face six traffic-related charges arising from the November 19, 2025 incident, which quickly went viral on social media.

The prosecution told the court that Ndeda was captured on video fleeing after a traffic officer attempted to stop him, an action that endangered other road users and amounted to reckless driving under the Traffic Act.

He was also accused of picking up passengers at an unauthorized location, contributing to congestion and unsafe boarding practices, and of not wearing the mandatory Public Service Vehicle (PSV) uniform, in violation of Section 103A of the Traffic Act.

Ndeda faced additional charges for ignoring police instructions, failing to stop when directed, and skipping his first court appearance on November 21, prompting another charge for failing to appear in court.

Defending himself, Ndeda told the court that he did not intend to evade arrest, claiming he had rushed off in panic due to an uncontrollable bout of diarrhoea.

His explanation drew murmurs in the courtroom, but the magistrate noted that medical reasons did not excuse reckless behaviour on the road.

After considering the charges, the court imposed a total fine of sh 70,000, warning Ndeda and other PSV operators that endangering the public and ignoring lawful police commands would not be tolerated.
