The death and burial of KCB executive Rosemary Chemutai have taken an unexpected turn after her family reportedly proceeded with her burial at night despite a court order that had temporarily stopped her interment.
The development has opened a fresh chapter in a dispute that had already exposed deep divisions between Chemutai’s family and her husband, Kevin Migwe Kimwatu, over where the senior banking executive should be laid to rest.
According to court proceedings, Kimwatu had moved to court seeking to stop the burial, arguing that he had been sidelined from decisions concerning his late wife’s final send-off.
The court subsequently issued interim orders suspending the planned interment and directing that the body should not be removed from the funeral home for burial without his involvement.
However, reports that Rosemary Chemutai was eventually buried at her family’s home in Chepseon, Kericho County, under the cover of darkness have now raised fresh questions about what happened after the court intervention.
Husband challenged burial plans
The legal battle reportedly began after disagreements emerged over Chemutai’s final resting place.
Kimwatu wanted his wife buried at their ancestral home in Matasia, Ngong, in Kajiado County.
Her family, however, reportedly favoured having her buried at her parents’ home in Chepseon, Kericho County.
The disagreement eventually found its way to court, with the husband seeking legal intervention to prevent the burial from proceeding without his participation.
The court’s intervention temporarily brought the funeral arrangements to a halt.
The circumstances surrounding the eventual burial have therefore attracted considerable public interest, particularly because of reports that the interment took place at night.
Rosemary Chemutai’s impressive career
Away from the family dispute, Rosemary Chemutai was a highly accomplished professional whose career stretched across law, technology, data protection and public policy.
She was serving as KCB Group’s Head of Data Protection, having joined the banking institution in 2022 as a Data Protection Officer.
Her professional journey also included a stint at Safaricom, where she worked in public policy.
Chemutai was additionally involved in Kenya’s technology and digital-rights ecosystem, including through her association with KICTANet.
Her expertise in data protection placed her among professionals navigating the increasingly important intersection between technology, privacy and financial services.
Her death shocked colleagues
Chemutai’s death on August 21 shocked colleagues, friends and members of Kenya’s technology community.
Reports indicated that she died at her residence in Ngong.
A postmortem examination conducted by Chief Government Pathologist Dr Johansen Oduor reportedly concluded that she died by suicide.
Police investigations were subsequently launched, with reports indicating that relatives raised the alarm after she failed to respond.
Investigators reportedly found no suicide note at the scene.
Her death was particularly devastating to those who knew her professionally, with tributes highlighting her intelligence, professionalism and contribution to Kenya’s digital-policy space.
