The High Court has ruled that Nakuru Governor Susan Kihika and Nawasco Managing Director James Ng’ang’a face a choice of a six-month civil jail term or a sh2 million penalty.
The decision comes after their conviction for court contempt due to their guilt in unlawfully dumping waste into Lake Nakuru.
The lawsuit was filed by Baboon Project Kenya, claiming that Kihika and Ng’ang’a ignored a court order from September 26, 2024, prohibiting waste disposal into the lake.
The directive intended to stop additional pollution of Lake Nakuru, yet the NGO asserts that waste disposal persisted, harming the ecosystem.
Although they knew about the court’s decision, the county government and Nawasco reportedly persisted in dumping garbage and hazardous industrial waste into the lake.
The petition emphasized the harm to the environment, especially concerning wildlife and species such as baboons.
Governor Kihika disagreed with the case, contending that she was not accountable for Nawasco’s functions.
Nonetheless, the court highlighted that the county government has the main duty of overseeing and safeguarding the environment of Lake Nakuru.
